Adoption
Adoption refers to the act where an adult formally becomes the guardian of a person, usually a child, and incurs the rights and obligations of a parent.
The length of time to complete the adoption process varies depending on the type of adoption and circumstances of each case.
A basic view of the court process is as follows:

A Petition for Adoption is filed with the Clerk of Superior Court and assigned a civil action file number.

The Petitioner(s) provides a copy of the Petition for Adoption to the staff of the assigned Judge, including a blank Rule Nisi for the Judge’s signature.

If a fingerprint-based background check is required, the background check is be conducted as provided by law at a Georgia Applicant Processing Service (GAPS) location. Learn more about registering and scheduling an appointment here.

Petition is reviewed and any missing, corrected or additional required items are submitted.

Once Petition is complete, rule nisi is signed and case set for hearing.

The Final Order must include the number of certified and regular copies needed.
